Regulations for Use of the Website - Central Library for the Blind, Visually Impaired and Handicapped (RA)
1. General
1.1 The Library's website (hereinafter: "The Website"), developed and operated by the Central Library for the Blind, Visually Impaired and Handicapped (RA) (hereinafter: "The Library") serves as a library and marketing environment online, accessible to all users according to their varying needs. The Library Website was established, and is operated, for the purpose of continuous improvement of the level of service to Library subscribers, enrichment of the accompanying literary content, streamlining the fundraising system and receiving service fees using secure online financial systems, and in fact, strengthens the links between the Library and the end users – subscribers, support system, donors and various interested parties.
1.2 Wherever the masculine form is used in these Regulations, the feminine is also intended.
1.3 The instructions in these Regulations apply to any use/browsing, including any financial transaction – payment/purchase/donation, carried out on the Website and through it, and will constitute the legal basis for relations between you and the Library; hence, you are requested to read these regulations carefully in full, including the preservation of privacy policy. To clarify and to remove all doubt, browsing on the Website and/or using materials whose source is on the Library website, and/or purchasing products or services offered for sale on it and/or carrying out online donations, constitutes your agreement to accept and behave according to the regulations. Therefore if you do not agree to any of its conditions you are requested not to use the Website.
1.4 The Library reserves the right to change these Regulations at any time and for any reason at its sole discretion.
2. Activities on the Website
2.1 Browsing the Website
The Website is open to the entire population according to what is detailed below, subject to the Library's sole discretion.
2.2 Borrowing books/titles/other materials through the Website
2.2.1 All library activities, i.e. borrowing books, newspapers etc., is open and available only to Library subscribers who have been approved by the Library. The Library may choose to limit the online activity of a group of subscribers, and only it has this right.
2.2.2 As long as payment of a service fee to the Library is not mandatory for subscribers, a subscriber who chooses not to pay the service fee will not be able to use the various Website services without the Library's approval and without his renewed status as active in the system. To regulate online use in these cases, the subscriber must initiate contact with the Library's registration department.
2.2.3 The Library's book lending services are available to the Library's subscribers only, those who are visually or reading impaired and who have presented the relevant certificates which are detailed on the Library website or which have been conveyed to the subscriber orally. Without presentation of an appropriate, valid and legal certificate, the Library cannot serve the person wishing to become a subscriber.
If a change occurs in a subscriber's seeing or reading ability, it is his responsibility to report said change to the Library, and if he wishes to continue being a Library subscriber he must present the appropriate certificates.
2.2.4 Borrowing materials from the Library Website is permitted only for Library subscribers' private use. In order to borrow materials by downloading them, the subscriber must identify himself and confirm that the item is for his personal use and that he will not pass it on to a third party.
Anyone who makes use of an item downloaded in any way from the Website, which is not for his personal use, is breaking the Adaptation of Works, Performances and Broadcasts to People with Handicaps Law (amendment), 2014, and Library regulations. In addition, the Library is permitted to take legal steps against him and also to cancel his subscription.
2.3 Service fee payment/making a purchase/donating through the Website
2.3.1 The Library enables payment of service fees and donating to the NPO through the Website.
2.3.2 Immediately following the transaction, the Library will run a check on the credit card details, and once the transaction is approved by the credit company, an appropriate message will be sent that the transaction has been approved or denied. If it is approved, you will be issued a receipt according to the type of payment; confirmation will also be sent by email that the transaction has gone through.
2.3.3 If the transaction is not approved by the credit company, a Library representative will contact the subscriber to complete the transaction. To clarify and emphasize, a transaction will be considered complete only after getting approval from the credit company to complete the transaction by the person making the transaction.
2.3.4 Delivery costs detailed on the Website do not include irregular delivery and/or delivery outside Israel. Irregular delivery means delivery to high floors with no possibility of delivering by elevator and/or deliveries requiring extra manpower and/or special equipment. In case of irregular delivery and/or delivery outside Israel, the Library is entitled to collect extra payment in addition to the payment collected for a regular delivery. In any case it must be clarified that as regards physical delivery of materials issued by the Library for its subscribers, with regard to delivery within the State of Israel, packages are sent to subscribers by messenger post.
This service is provided to Library subscribers free of charge, as long as the service is given to the Library free of charge by the operating provider or if another financing entity is appointed. As regards delivery of materials with the exception of its overseas subscribers, the Library will do its utmost to make use of various services offered by the state, to supply the delivery to its subscribers free of charge. It must be noted that regarding mail outside the country, if the subscriber requests the package within a shorter time than is possible by the service given to the Library free of charge and/or if the Library has no means of delivering the materials to the subscriber at no cost to itself, the subscriber may have to bear the costs, subject to his approval.
2.3.5 The place of conducting the transaction, to all intents and purposes, is considered the city of Tel Aviv, even in cases where the subscriber chooses to receive the product at the post office or by messenger.
2.3.6 The Library takes the customary precautions in order to maintain, as much as possible, confidentiality of information. Any transfer of a credit card number from the Website is encoded according to regulations; however, in cases which are not under its control or which stem from force majeure, the Library will not be responsible for any damage of any kind, indirect or direct, incurred by the subscriber and/or anyone on his behalf if this information is lost or if unauthorized use is made of it.
2.3.7 Cancellation of a transaction/sale/or failure of compensation
a) The person making the purchase is entitled to cancel the transaction according to directions in the Consumer Protection Act and regulations formulated in accordance with it.
b) The Library is entitled to cancel a transaction and/or a total or partial sale:
1. When a clerical error is found in the offer, whether in a product's price or in a product's description.
2. If it becomes clear that the transaction and/or the sale was accompanied by illegal activity by the purchaser and/or any third party.
3. If it becomes clear to the Library that the purchaser may resell the product or the service from the Library to a third party and/or trade in it.
4. A message of cancellation of a transaction will be sent to the purchaser by telephone and/or in writing to his address.
Responsibility
The Library and/or anyone on its behalf will not be responsible and will not be liable for any indirect damage, consequential or unusual, caused to the user or to a third party, as a result of use or purchase using the Website – whatever the prosecution's reason, including loss of income and/or prevention of income caused by any reason. In any case, the Library's responsibility is limited to the purchaser's money being returned. For safety's sake and to remove all doubt, The Library is not responsible for any disruption and/or failure and/or error and/or mistake and/or omission on the Website and/or in the Website's contents and/or in its data and/or in its various applications and/or in its operation, including any damage caused to the user's property including his computer and/or any other terminal equipment used by the user.
2.5 Icons, any data and/or display appearing on the Website, including graphics, verbal presentation, trademarks, logos, and also editing and presenting these, are under the Library's sole ownership and/or anyone on its behalf. It is forbidden to copy, duplicate, distribute, publish or make use in any other way of the contents appearing on the Website unless the Library has given its consent to this, in writing and in advance. Note that part of the Website's written content has its source in websites where the data is free and open for public use, i.e. ULI, the Union List of Israel. If necessary, credit is given to the original writer in the body of the article.
2.6 The Library's computer notes regarding activities taking place through the Website are prima facie evidence of the activities' correctness. Support Services
The Library provides technical support services to its subscribers through the "Migdalor" organization, a service provider for the Library.
2.7.1 The Library has the right to stop this service at any time or to change the operating service provider.
2.7.2 A subscriber who chooses to contact the Library's technical support services hereby agrees for the support provider to keep in their computerized system the subscriber's personal information which the subscriber himself gives them (whether he contacts them by telephone or by email). The Library on its part will not give out additional information about the subscriber.
3. Miscellaneous
3.1 The interpretation and enforcement of these Regulations and/or of any action or disagreement arising from it, will be done according to the laws of the State of Israel, and will be resolved, if necessary, in authorized courts of law in Tel Aviv only.
3.2 The regulations were last updated on 06/05/2015 and may be changed at any time by the Library, at its sole discretion.
3.3 Jurisdiction in all matters pertaining to these Regulations is in authorized courts of law in Tel Aviv only.
